Booking Conditions
1 DEFINITIONS
In these terms and conditions:
1.1 "the Booking Form" means either the booking form completed by You on the Tours International website or the booking form sent to you by e-mail by Tours International which includes details of the Holiday and the Holiday Price and which is said to be subject to these terms and conditions
1.2 "the Conditions" means the standard terms and conditions set out in this document and any additional conditions specified in the Booking Form and unless the context otherwise requires includes any special terms and conditions agreed in writing between Tours International and You
1.3 "the Contract" means the contract for the provision of the Holiday
1.4 "the Deposit" means the deposit payable by You to Tours International when submitting the Booking Form details of which appears on the Booking Form
1.5 "the Holiday" means the holiday, tour or excursion to be provided to You by Tours International details of which appears on the Booking Form by reference to a tour number or other description and any extra items requested by You
1.6 "the Holiday Price" means the total price payable to Tours International for the Holiday shown in the Booking Form (or price list appearing on the Tours International website) including, where applicable, the Deposit
1.7 "the Regulations" means The Package Travel, Package Holidays and Package Tours Regulations 1992.
1.8 "Tours International" means Tours International Limited (company registration number 02158509) whose registered office is at Portland, 25 High Street, Crawley, West Sussex RH10 1BG, UK.
1.9 "You/Your" means the customer with whom the Contract is made and whose details appears on the Booking Form.
2 SUPPLY OF HOLIDAY
2.1 Tours International shall supply the Holiday in accordance with the Booking Form subject to Tours International's acceptance (which shall be communicated by the sending of a confirmation invoice to You) of the Booking Form submitted by You on the Tours International website or by e-mail and subject also to the payment of the charges in accordance with Condition 3 and to the Conditions which will govern the Contract to the exclusion of any other terms and conditions
2.2 No variation to the Conditions shall be binding unless agreed to in writing by a duly authorised representative of Tours International
2.3 Tours International may at any time without notifying You make any changes to the Holiday which are necessary to comply with any applicable safety or other statutory requirements, or which (in Tours International's reasonable opinion) do not materially affect the nature or quality of the Holiday
2.4 Employees or agents of Tours International are not authorised to make any representations concerning the Holiday unless confirmed by a duly authorised representative of Tours International in writing and in entering into the Contract You acknowledge that You are not relying on and waive any claim for a breach of any such representations which are not so confirmed
2.5 Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Tours International (whether appearing on the Tours International website or otherwise) shall be subject to correction without any liability being incurred by Tours International
2.6 All prices shown on the Tours International website are valid for acceptance only on the day the website is accessed and may be varied by Tours International thereafter.
2.7 All holidays shown on the Tours International website are subject to availability
2.8 After Tours International's acceptance of the Booking Form submitted by You the Holiday Price may be revised by Tours International (either upwards or downwards) to allow for variations in:
2.8.1 transportation costs, including the cost of fuel; and/or
2.8.2 duties, taxes or fees chargeable for services such landing taxes or embarkation or disembarkation fees at ports and airports; and/or
2.8.3 the exchange rates applicable to the Holiday
Any such variations shall be subject to a minimum variation of 2% of the Holiday Price and shall be passed on to You at the cost incurred by Tours International plus any reasonable administration fee and no such variation will be made less than 30 days prior to the date of commencement of the Holiday
3 DEPOSITS AND PAYMENTS
3.1 You agree to pay the Deposit by credit card or direct bank transfer when submitting the Booking Form to Tours International in accordance with Condition 2 and this is Your only payment commitment until eight weeks before the commencement of the Holiday
3.2 Payment of the remaining Holiday Price after deducting the Deposit as expressed in the confirmation invoice will be due without further notice eight weeks before the commencement of the Holiday
3.3 Any bookings made within eight weeks of the commencement of the Holiday must be accompanied by payment of the Holiday Price in full
3.4 If You fail to make any payment on the due date then, without prejudice to any other right or remedy available to Tours International, Tours International shall be entitled to:
3.4.1 cancel the Holiday; and/or
3.4.2 charge you interest both before and after any judgment on the amount unpaid at the rate of 5% per annum above the National Westminster Bank Plc base rate from time to time until payment in full is made; and/or
3.4.3 retain the Deposit
3.5 All payments made under the Contract are to be made in UK Pound Sterling unless expressly stated otherwise
4 CHANGES TO YOUR BOOKING
4.1 If You want to change any of the travel arrangements specified on Your Booking Form which do not materially alter the cost to Tours International of providing the Holiday and You have paid the Deposit or the full amount of the Holiday Price, Tours International will (subject to clause 4.2) do all it reasonably can to accommodate Your new requirements
4.2 An alteration fee of UK £60 per person will be charged for any such change to cover administration costs, except within eight weeks of the commencement of the Holiday when any such request will be treated as a cancellation in accordance with clause 5 below
5 CANCELLATIONS
5.1 If You wish to cancel the Holiday after Your booking has been confirmed You must inform Tours International in writing by e-mail or letter as soon as possible
5.2 If You do cancel, Tours International reserves the right to charge you a cancellation fee based on the following scales:

5.3 No refunds for cancellations made on or after the date of commencement of the Holiday can be given
6 INSURANCE
Tours International would recommend that You take out an insurance policy to cover the cost of cancellation by You of the Holiday or the cost of assistance (including Your repatriation) in the event of accident or illness. Such policies are available from your airline or travel agent or www.travelsafe.com
7 LIMITATION OF LIABILITY
IF YOU WISH TO PROTECT YOURSELF AGAINST ANY GREATER LOSS OR EXPENSE THAN THE LIMIT OF TOURS INTERNATIONAL LIABILITY UNDER THIS CLAUSE 7, YOU ARE HEREBY PUT ON NOTICE THAT YOU SHOULD PUT IN PLACE APPROPRIATE INSURANCE
7.1 Tours International accepts liability without limitation in the event of death or personal injury to any person arising out Tours International's negligence or the negligence of its agents or employees.
7.2 Tours International accepts liability for physical damage to or loss of Your tangible property directly caused by Tours International up to the amount of £1,250.00 (one thousand two hundred and fifty pounds) in respect of any one accident or series of connected accidents
7.3 Tours International accepts liability in all other cases not falling within this clause 7 (whether in contract, tort (including negligence) or otherwise) under or in connection with the Contract to a limit of the Holiday Price
7.4 Tours International shall not be liable for:
7.4.1 any losses suffered by You which You are able to recover under a policy of insurance taken out by You; or
7.4.2 any losses suffered by You if You have not paid the Holiday Price due under the Contract; or
7.4.3 any loss sustained by You if such loss is due to any cause beyond Tours International's reasonable control; or
7.4.4 any losses suffered by You as a result of any act or omission on Your part or on the part of a member of Your family or of any party accompanying You on the Holiday
7.4.5 any losses suffered by You of an indirect or consequential nature including (but not limited to) loss of profits
8 COMPLAINTS
Naturally, Tours International hopes and expects that the Holiday will not give any cause for dissatisfaction. Should You wish to make a complaint, however, please do so in writing by e-mail or letter to Tours International within 28 days of the completion of the Holiday. Any matter which may give rise to a complaint should, in the first instance, be reported to the hotel or other supplier (and to the police where appropriate) as soon as practicable after the event giving rise to the complaint
9 DATA PROTECTION
Tours International will use Your personal information in accordance with our privacy policy as set out at https://www.tours-international.com/privacy-policy
10 FINANCIAL SECURITY UNDER THE REGULATIONS
10.1 Tours International have put in place arrangements under the Regulations to protect any funds paid by You to Tours International and (where applicable) for Your repatriation in the event of Tours International's insolvency
10.2 All monies paid by You to Tours International under the Contract will be held in a trust account by an independent professional trustee (which is similar to an American escrow arrangement). Monies will not be released to Tours International until You have returned from the Holiday

11 YOUR HOLIDAY
11.1 Subject always to Condition 2.3, if Tours International have to make any significant changes to Your Holiday, Tours International will inform You as soon as reasonably possible and You shall have the choice of the following:
11.1.1 Accepting the revised arrangements as confirmed to You; or
11.1.2 Accepting another holiday of a similar standard; or
11.1.3 Accepting a holiday of a lesser standard together with a refund of the difference between the price of that holiday and the Holiday Price; or
11.1.4 Cancelling the Holiday
11.2 If You choose either option 11.1.1, 11.1.2 or 11.1.3 above, Tours International shall pay You reasonable compensation on the scale shown below
11.3 If You choose option 11.1.4 Tours International shall refund Your money paid to Tours International plus reasonable compensation on the scale shown below:

11.4 The following is a non-exhaustive list of the changes to the Holiday which Tours International considers significant where You should be entitled to compensation/cancellation;
11.4.1 Delay in departure or return of more than 12 hours
11.4.2 Change in the type of accommodation to accommodation of a significantly lower standard
11.4.3 Material change in the location of accommodation to a totally different destination
11.5 The following is a non-exhaustive list of changes to the Holiday which Tours International does not consider to be significant where You shall not be entitled to compensation/cancellation;
11.5.1 Minor delay in the departure or return of less than 12 hours
11.5.2 Minor change in the type of accommodation to accommodation of a similar standard
11.5.3 Minor change in location of accommodation at the same destination
11.6 You shall not be entitled to any compensation where Tours International cancels the Holiday or makes any changes to the Holiday as a result of circumstances which are beyond Tours International's reasonable control including (but not limited to) war, national emergency, flood, terrorist activity, civil unrest, strike, industrial dispute, agricultural disease, and bad weather (whether actual or threatened)
12 TRAVEL TIMINGS AND TRAVEL REQUIREMENTS
12.1 Flight, cross channel and other travel timings referred on the Tours International website are for guidance only and are subject to change as a result of the carriers' procedures
12.2 You will need a valid passport for your Holiday and may also need visas. Full details of visa requirements can be obtained from the relevant embassy of the country or countries which you are visiting. Tours International does not accept any liability or responsibility for obtaining or advising upon requirements for passports, visas or any other travel documentation.
13 TERMS AND CONDITIONS OF CARRIAGE
When You travel by air, sea or coach on water, the carrier's conditions of carriage will apply to Your journey. Copies of applicable conditions are available direct from Tours International, or where applicable, from any travel agent through which the Holiday has been booked
14 LAW AND JURISDICTION
The Contract shall be governed by English law and both parties submit to the exclusive jurisdiction of the English courts.
